Why we need Jan Lokpal Bill?

Dear Friends,

It is now very important to know few facts about the Jan lokpal bill. What the bill all about and how it can help common man to get justice.

The bill is mainly drafted to control corruption and against corrupt government officials even of highest authority including PM. Corruption under law is a crime, its a heinous crime like murder and rape. In any developing country the wide difference in wealth between the rich and poor can lead to corruption because of the favors and power enjoyed by the rich. If the rich use the power for good then it will be fine but if the same is used against the poor then survival of the common man will be endangered. Hence corruption must be treated seriously and stamped out vigorously. Unless broader legal power is given to the Anti-corruption Agency, counter-corruption campaign will not be effective.

So with an intention to eliminate corruption from the roots, Jan lokpal billl is drafted. Anna Hazare along with other prominent people like Kiran Bedi, Arvind Kejriwal to name few have spent a lot of time working on different countries anti corruption policies, gathered opinions from people and drafted a bill in similar lines as of ICAC (Independent Commission Against Corruption, Hong Kong)  which from its inception on 1974 in Hong Kong has considerably reduced or i should say eliminated corruption in the many departments of the Hong Kong Government through law enforcement, prevention and community education. This is one of the main reason why now Hong Kong is the epicenter of rapid development. Anna's team considered good parts like these and drafted a Jan Lokpal bill to help a citizen from rich to poor to file a complaint against the corrupt officials in the path to seek justice.

We may ask our self why we need this bill as we have CBI, CVC (central vigilance commission) agencies already working on corruption and crime. Yes we do have these agencies to help us, but they are not independent bodies. They do not enjoy the powers to book a complaint against corrupt official until approved by the central government. CBI for example if they need to take action against an official or minister of high category needs to get permission from the same corrupt minister. Do you expect the minister to allow the CBI to take action? The answer is no and till date none of the ministers have given permission to have investigation to be performed on themselves. It has not happened now and will not happen in the future until strict independent body on anti-corruption is established.

The work of CVC also falls in the same lines as CBI. So these department are not of much help to the citizens.

We need a very strong independent body without any influence from the government. Jan Lokpal Bill drafted by Anna fulfills this as it is independent from government and enjoys the power to file complaint on corrupt officials or ministers including PM with no prior permission from anyone. The government is trying to portray the Jan Lokpal bill as parallel government, which is not true. The Jan Lokpal bill will just have the power to accept the complaint from the complainant, file a case against the corrupt official, investigate and move the case to the court. It will then be left to the court to take the final decision. So how come this bill will be a parallel government. The government is trying to mislead and confuse the people.

To still make things worst the government has drafted a Lokpal bill which is completely opposite to the Anna's Lokpal bill. So now we have two bills. Lets see the different between the two bills.

Under the purview of government's lokpal bill panchayats, ministers like MP's and MLA's, PM, scams related to roads, telecom all are exempted. So what's their in government's lokpal bill. The draft says if a citizen complaints against a government official of corruption or any other crime  and if the accusation is proved false then the citizen who complained will get an imprisonment of  2 years. The accused official has rights to file a complaint against the complainant and the accused will be provided a lawyer to fight the case in court on government expenditure. And if the accused is found guilty he or she will be dismissed from their service or have to face imprisonment for just 6 months. This is a synopsis from the government's draft . It has lot of provisions for the accused to escape.

Does this bill really help us in the fight against corruption? Does a common man ever dare to file a complaint if this bill is passed. There is no protection for the citizens in this bill.

On the other hand Anna's Lokpall bill has the rights to book official or minister even of highest authority, if a citizen complaints. It will also take up the responsibility to protect the complainant. So that more and more people can raise their voice against corruption. Corruption is a high profit and zero risk business and must be cleaned from the roots if we want to see a developed country.  @64 we are still a developing nation and if corruption continues this way even after many years we will still be a developing nation rather than a developed nation.

The government is trying to pass the Lokpal bill drafted by them. If that happens only god can save us.

Request everyone to support Anna's Jan Lokpal Bill. This is a very noble cause for a good purpose, for our bright future. It is now or never. This is the right time we show our support. We can show our support by accepting and attending A week for India initiative. Hope to see your support.

Happy Independence Day!!

Where The Mind Is Without Fear!! by Rabindranath Tagore

Where the mind is without fear and the head is held high
Where knowledge is free
Where the world has not been broken up into fragments
By narrow domestic walls
Where words come out from the depth of truth
Where tireless striving stretches its arms towards perfection
Where the clear stream of reason has not lost its way
Into the dreary desert sand of dead habit
Where the mind is led forward by thee
Into ever-widening thought and action
Into that heaven of freedom, my Father, let my country awake!!
